Companies are expected to comply with various laws and regulations, such as:

  • the charter for the Communication and Promotion of Health Products on the Internet and E-media of ANSM (the "Charter");
  • the recommendations published by the National Agency for Medicinal drugs Safety ( “ANSM”);
  • the code of practice issued by the French pharmaceutical companies’ union, “LEEM”;
  • the code "Information on the medicinal product and editorial advertising" by the LEEM, SPEPS and UDA (media trade unions);
  • the EFPIA Code on the promotion of prescription and interactions with healthcare professionals.

Advertisement of non-prescription medicines to the general public is possible in the following cases:

  • if the medicine is not covered by mandatory French social security system;
  • if the marketing authorisation does not contain any restrictions ot prohibition on advertising;
  • if the medicine is not under a temporary authorisation of use.

Even in these cases the product must be clearly identified as a medicine and the promotional nature of the advertising must be obvious.

Advertisement (including internet promotion) of prescription medicines to the general public is forbidden. This includes not displaying prices for such products in price catalogues or price lists , as well as using any terms involving a hierarchy, such as "leader" etc.

Information about prescription medicine that may be accessed by members of the public on the website includes institutional information about veterinary health or diseases, adverse-reaction warnings within a pharmacovigilance context.
